About these terms
These terms are an agreement between you and Boolbyte Technologies ("Boolbyte", "we", "us"), a company registered in Nigeria and based in Lagos, Nigeria. Our registered details are in the footer of every page.
By using the website or any of our products you agree to these terms. If you use a product on behalf of an organization, you agree to them for that organization and confirm you are authorized to do so. Where an organization has signed a separate agreement with us, that agreement governs where it differs from these terms.
Our products
- ByteOps is software for healthcare organizations to run administrative work: setup, patient messages, appointments, approvals, insurance work, and follow-ups.
- ByteNetwork connects organizations so they can send referrals and requests to each other and coordinate care.
- ByteCare is an app for people to find care, book visits, follow referrals, and keep their health details in one place.
- ByteEngine gives developers managed FHIR servers and AI model endpoints through APIs.
Organizations that use our products also agree to our data processing agreement. How we handle personal data is described in our privacy policy.
Accounts and organizations
- Give accurate information when you create an account, and keep it up to date.
- Keep your sign-in details and API keys secret. Tell us at once if you think someone else has used them.
- An organization's owners and admins decide who has access, what role each person has, and which automated actions need a person's approval. The organization is responsible for what its users do in the product.
- You must be at least 18 to hold an organization account. A person under 18 may use ByteCare only with a parent or guardian.
Acceptable use
You must not:
- break the law, or use the products to process data you have no right to process;
- put identifiable health information somewhere we have told you not to;
- try to reach data that belongs to another organization or person, probe or break our security, or get around rate limits or access controls;
- send spam, or messages people have not agreed to receive;
- use the products to build a competing service by copying them, or resell them without our written agreement;
- upload malware, or anything that interferes with the service.
If you find a security weakness, report it as described on our security page and do not exploit it.
Not medical advice
Boolbyte is a technology company, not a healthcare provider. Our products help people and organizations organize and coordinate care. They do not diagnose, prescribe, or replace the judgement of a qualified healthcare professional. Clinical decisions stay with clinicians.
In an emergency, call 112 (Nigeria's emergency number) or go to the nearest hospital. Do not wait for a reply in any of our products.
AI features
Some features use AI models to read and write messages, suggest actions, and summarize information. AI can be wrong. In ByteOps, each organization sets which actions need a person's approval, and anything the rules don't cover goes to staff. You are responsible for reviewing what an AI feature proposes before you rely on it. How we use AI, and its limits, are set out on our responsible AI page.
We do not use your data, or your patients' data, to train AI models. The model providers we use are listed on our subprocessors page.
Your data
You keep all rights in the data you put into our products. You give us permission to store and process it only to provide, secure, and support the products for you, as described in the data processing agreement and the data policy. You are responsible for having a lawful basis, and any consent needed, for the personal data you give us.
ByteEngine
These terms apply in addition when you use ByteEngine.
- Your data. Only store data in a ByteEngine server that you are permitted to process. Do not put identifiable health information in a project until we have confirmed in writing that it is set up for it, and keep your own copy of anything you cannot afford to lose.
- Limits. Each organization may run a limited number of servers, and each API key has a request rate limit. We may change these limits as the service grows.
- API keys are shown once, are scoped to what they may do, and expire. You are responsible for every call made with your keys.
- Model endpoints. Some models run on third-party providers. The catalogue shows, for each model, whether it is sent to an external processor. Only use those models where you are allowed to send that data to that provider.
- ReFHIR. ByteEngine's FHIR servers run ReFHIR, the open-source FHIR R4 server our team builds. ReFHIR's source code is available under its own open-source licence, which governs your use of that code.
ByteCare
These terms apply in addition when you use ByteCare.
- ByteCare's assistant is automated. It helps you find services, make requests, and follow your care. It is not a doctor, nurse, or pharmacist, and it does not give medical advice.
- When you send a request to a clinic, that clinic answers it and is responsible for the care it gives you. What you share with a clinic is also governed by that clinic's own notice, which ByteCare shows you.
- Keep your profile accurate, especially your contact details, so clinics can reach you.
- If you add details about another person, such as a child, you confirm you are allowed to act for them.
Fees
Fees for ByteOps and ByteNetwork are set in the order or agreement your organization signs with us. Any ByteEngine charges are shown in the console before they start. ByteCare is free for people to use.
Intellectual property
We own the products, the website, and our trademarks, including Boolbyte, ByteOps, ByteNetwork, ByteCare, and ByteEngine. These terms give you the right to use the products while your account is active. They don't transfer any ownership. If you send us feedback, we may use it without obligation to you.
Suspension and termination
You can stop using the products at any time. We may suspend or close an account that breaks these terms, puts other users or patients at risk, or where the law requires it. Where we can, we will tell you first and give you the chance to fix the problem. After an organization's account closes, we return or delete its data as set out in the data processing agreement.
Disclaimers
We work hard to keep the products accurate and available, but we provide them "as is". To the extent the law allows, we do not promise that they will be uninterrupted or free of errors, or that an AI output will be correct. Nothing in these terms limits a right you have under the Federal Competition and Consumer Protection Act 2018 or any other law that cannot be limited by contract.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, or data, and our total liability to an organization under these terms in any 12 months is limited to the fees it paid us in that period. Nothing limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Changes to these terms
Each version of these terms has a version number and an effective date, shown at the top of this page. When we make a change that matters, we tell account holders before it takes effect and, where the change needs it, ask you to accept the new version before you continue. We keep a record of the version each account accepted.
Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. We will try to settle any dispute with you informally first. If we cannot, the courts of Lagos State have jurisdiction, unless an organization's agreement with us says otherwise.
